Center for Financial Transaction Reports and Analysis Center (PPATK) reveals there are three things that cause Indonesia into the black list of the Financial Action Task Force (FATF).
Deputy Head of PPATK, Agus Santoso said there were three weaknesses in the Act number 9 of 2013 on the Prevention and Combating the Financing of Terrorism Crime.
Indonesia, he added, was asked to freeze all assets and accounts in the name of terrorist suspects listed in the United Nations Security Council (UNSC) in 1267.
UNSC 1267 issued by the Security Council of the United Nations lists the names of suspected terrorists who entered the Al Qaeda and Taliban sactions lists.
"There are three weaknesses of the law we become the cause of Indonesia blacklisted in 2012. Now it has been our three elimination and give a solution," he told Bisnis.com, Friday (03/06/2015).
Agus explained, among other weaknesses of the freezing of assets without any lag time. In the Indonesian regulation freezing the assets of terrorists process is done within 30 days.
"30 days was considered too long when it should be no lag time," he said.
Second, the term of the asset freeze set in positive law in Indonesia, namely in one year.
The latter is the regulatory authority in Indonesia allowed the court to make the process of delisting or removal of suspected terrorists on the list even though unexpected UNSC has not been removed from the list in 1267.
"The Indonesian justice system is independent and free, so the court was entitled to delisting against suspected terrorists in Indonesia, thus opening opportunities for unilateral," said Agus.
The top three weaknesses, Indonesia and formed a task force or task force that made the answers or solutions to the three weaknesses.
Of the task force and produced a joint decree (SKB), which was signed by the Chairman of the Supreme Court (MA), Minister of Foreign Affairs, INTRAC, the National Counter-Terrorism Agency (BNPT), and the Chief of Police.
"This decree has become news events and binding state. We have given SKB to FAFT and they can accept and can be used as guidelines so that we can get out of the black list," he explained.
The decree contains answers to three weaknesses in the regulation of combating terrorism in Indonesia.
